Boating Accident Report (CLOSED 1/5/22)

BACKGROUND

On July 31, 2015, the Coast Guard published a 60-day Federal Register Notice of its intent to submit an information collection request (ICR) to the Office of Management and Budget (OMB) requesting approval of an extension of an already-approved collection, 1625-0003 Boating Accident Report (BAR). At that time, the Coast Guard BAR form (CG 3865 and CG 3865SP) was set to expire Dec. 31, 2015.

Before submitting the ICR, the Coast Guard invited public comment. At Regulations.gov, under Docket USCG-2015-0629 the Notice, supporting material, and five comments that were submitted can be viewed, including one from NASBLA as a result of membership action (see links immediately below).

On Dec. 28, 2015, the Coast Guard published the follow-up Federal Register Notice indicating that it was forwarding the ICR for approval of the extension of the BAR collection to the OMB Office of Information and Regulatory Affairs (OIRA). The Notice presented the Coast Guard's responses to the comments that were submitted during the original comment period, and per the responses, the Coast Guard did not make any changes to the BAR collection--or to the form--at that time. Since OIRA required a 30-day comment period as part of the request, however, the Notice allowed for submission of additional comments to the Docket USCG-2015-0629 at Regulations.gov OR directly to OIRA by email at OIRA-submission@omb.eop.gov (or other methods cited in the Notice). The deadline for submissions was Jan. 27, 2016.

MORE RECENT ACTIVITY - 

The BAR form that was approved as a result of the 2016 review was set to expire on March 31, 2019. On Nov. 20, 2018, after a series of internal delays, the U.S. Coast Guard published the 60-day Federal Register Notice citing its intent to submit an information collection request (ICR) to OMB for approval of an extension to the collection 1625-0003 Boating Accident Report (BAR). The Notice invited public comment through Jan. 22, 2019 (www.regulations.gov, Docket USCG-2018-0881).

OF NOTE: Although the Notice stated the extension of the collection was “without change,” the data collection instrument that ensures compliance with regulation—the proposed CG 3865 form (posted as a supplemental document to the docket on Nov. 28)did present some modifications to bring the Coast Guard into alignment with term changes that were authorized in CFR as a result of the 2012 issuance of the Final Rule on Changes to SNS, VIS and BARD.

The changes affected the terms for vessel types, propulsion type, fuel type, and engine type, and deleted the “amount” of fire extinguishers used. The form modifications were parallel to the BARD-Web input and other reporting system changes that the Coast Guard's Boating Safety Division made in July 2018 as an interim step toward compliance with CFR while awaiting the collection form to move through the internal review and approval processes, and then, on to publication for public comments.

On March 1, 2019, the U.S. Coast Guard published the 30-day Federal Register Notice that it would be forwarding the information collection request (ICR) to OMB for approval of extension to the BAR collection. The Notice invited final public comment through April 1, 2019 (www.regulations.gov, Docket USCG-2018-0881), and also documented the Coast Guard's response to NASBLA's submission from the 60-day comment period.

Ultimately, OMB approved a revised CG-3865, reflecting the changes in CFR that took effect Jan. 1, 2017, and with an expiration date of July 31, 2022.

Most recently, in anticipation of the 2022 expiration of the current BAR collection and form, on Aug. 30, 2021, the Coast Guard published the 60-day Federal Register Notice citing its intent to submit an information collection request (ICR) to OMB for approval of an extension to the collection 1625-0003 Boating Accident Report (BAR). The Notice invited public comment through Oct. 29, 2021 (www regulations.gov, Docket USCG-2021-0629).

On Dec. 6, 2021, the Coast Guard published the 30-day Federal Register Notice that it would be forwarding the ICR to OMB for approval of extension to the BAR collection. The Notice invited final public comment through Jan. 5, 2022 to www.regulations.gov, Docket USCG-2021-0629 and/or to OIRA at https://www.reginfo.gov/​public/​do/​PRAMain
