Boating Accident Report (CLOSED 1/30/26)

        On Dec. 1, 2025, the Coast Guard published a 60-day Federal Register Notice stating its intent to submit an Information Collection Request (ICR) to the Office of Management & Budget (OMB) for an extension of approval of 1625-0003, Coast Guard Boating Accident Report Form, without change. The current CG-3865 form, dated Aug. 1, 2024 with an expiration of Feb. 21, 2028 already had been revised in March 2025 to accommodate an Executive Order resulting in a change of references on the form from “gender” to “sex.” 

        NASBLA's Engineering, Reporting & Analysis Committee (ERAC) submitted a comment to Docket USCG-2025-0351 at www.regulations.gov on Jan. 30, 2026. While the committee expressed support for the collection, it questioned why the ICR would be “without change” given that there were new or revised terms as a result of the issuance of CG-BSX PL 23-01, CH-1. The ERAC submission did not suggest a resolution. 

        However, in advance of the publication of the 30-day Notice in which the Coast Guard must respond to the submitted comment, the committee was afforded the opportunity to follow up on its initial submission with potential resolutions and to suggest how the CG-3865 would need to be revised to meet the minimal alignment with the policy letter changes. Those suggestions focused on three areas of the form -- the Accident Events (incident types) terms, the recording of damages for purposes of meeting the federal threshold, and injury treatment beyond first aid. In offering the suggestions, however, the committee was advised that additional changes to the form might need to take place in the larger context of a redesign of the Boating Accident Report Database (BARD) underway in 2026.
